OH SO NAUGHTY – SHIPPING & DELIVERY POLICY

At Oh So Naughty, we aim to deliver your order safely, discreetly and as efficiently as reasonably possible.
This Shipping & Delivery Policy applies to orders delivered within the Republic of South Africa and should be read together with our:

Terms & Conditions;

Returns, Exchanges, Refunds & Product Warranty Policy; and
-
Privacy Policy.
Nothing in this policy is intended to limit any consumer right that cannot lawfully be excluded under South African law.
1. SHIPPING WITHIN SOUTH AFRICA
We currently offer delivery within South Africa.
Our standard shipping option is Economy Shipping.
Delivery is carried out by third-party courier companies.
2. ECONOMY SHIPPING COST
Our current standard Economy Shipping charge is:
R149 per order for orders below R2,500.
Orders with a merchandise value of R2,500 or more qualify for free standard Economy Shipping, unless expressly stated otherwise.
Free shipping applies to the standard delivery option only.
Additional charges may apply where:

A customer requests a special delivery service;
-
A parcel requires re-delivery due to customer-related circumstances;
-
A delivery address falls outside normal courier service areas and a special surcharge applies; or
-
Another delivery arrangement is specifically agreed with the customer.
Any applicable delivery charge will be displayed or communicated before the customer is required to pay it.
3. DELIVERY TIME
Standard Economy Shipping normally takes approximately:
5–7 business days
after the order has been processed and dispatched.
Delivery estimates are not guarantees unless we have expressly agreed to a guaranteed delivery date in writing.
Business days exclude:

Saturdays;
-
Sundays; and
-
South African public holidays.
4. ORDER PROCESSING
Delivery time should be distinguished from order-processing time.
Orders may require processing before being handed to the courier.
Processing may include:

Payment confirmation;
-
Fraud screening;
-
Stock confirmation;
-
Picking and packing;
-
Supplier fulfilment where applicable; and
-
Courier collection.
Where a product is subject to a longer lead time, pre-order, supplier dispatch or other special fulfilment arrangement, this will be communicated where reasonably possible.
5. DELIVERY ESTIMATES
Delivery estimates are provided in good faith based on normal courier performance.
Actual delivery times may be affected by circumstances including:

Delivery location;

Courier-network volumes;
-
Public holidays;
-
Peak shopping periods;
-
Severe weather;
-
Road closures;
-
Strikes;
-
Civil unrest;
-
Load or infrastructure disruptions;
-
Courier operational issues;
-
Incorrect customer information; or
-
Other circumstances beyond our reasonable control.
We will nevertheless comply with our obligations under applicable South African consumer law.
6. RURAL & OUTLYING AREAS
Deliveries to rural, remote, farm, regional or outlying areas may take longer than standard metropolitan deliveries.
Please allow approximately 1–2 additional business days, although certain destinations may take longer depending on the courier network.
Some remote areas may only be serviced on particular days.
7. DISCREET PACKAGING
We understand that privacy is extremely important when purchasing adult products.
Orders are therefore packaged as discreetly as reasonably possible.
Our parcels are generally sent in:

Plain courier bags;
-
Plain boxes; or
-
Other non-descriptive outer packaging.
The external packaging will not intentionally describe the intimate contents of your order.
However, certain information may need to appear on shipping documentation where required by:

The courier;
-
Payment providers;
-
Applicable law; or
-
Delivery systems.
8. TRACKING INFORMATION
Once your order has been dispatched, tracking information will normally be sent to the email address or telephone number supplied with the order.
Customers are encouraged to monitor tracking information so that they can make arrangements to receive the parcel.
Courier tracking updates are generated by the courier and may occasionally be delayed or inaccurate.
9. DELIVERY ADDRESS
Customers are responsible for entering a complete and accurate delivery address when placing an order.
Please ensure that the address includes all relevant details, where applicable, such as:

Street number;

Street name;
-
Complex or estate name;
-
Unit number;
-
Suburb;
-
City or town;
-
Province;
-
Postal code;
-
Access instructions; and
-
Correct telephone number.
Please check the address carefully before completing checkout.
10. INCORRECT OR INCOMPLETE ADDRESSES
If you notice an error in your delivery address, contact us immediately at:
We will make reasonable efforts to assist if the parcel has not yet been dispatched.
Once a parcel has been handed to the courier, we cannot guarantee that the address can be changed.
The customer may be responsible for reasonable additional courier charges arising because:

An incorrect address was supplied;
-
An incomplete address was supplied;
-
The customer requests redirection after dispatch; or
-
A parcel must be returned and re-sent because of incorrect customer information.
This applies only to the extent permitted by law.
11. DELIVERY TO THE ADDRESS PROVIDED
Delivery will be attempted at the address supplied with the order.
The customer is responsible for ensuring that the delivery address is one where the courier can reasonably gain access during normal delivery hours.
We recommend using:

A home address where someone is normally available;
-
A business address;
-
An office reception; or
-
Another secure location where an authorised person can receive the parcel.
12. DELIVERY TO AN AUTHORISED PERSON
Where the customer supplies an address at which another person may reasonably accept the parcel on their behalf, delivery to that authorised person may constitute delivery to the customer, subject to applicable law and the circumstances of the transaction.
This may include:

A spouse or partner;
-
Family member;
-
Employee;
-
Receptionist;
-
Security personnel;
-
Building concierge; or
-
Another person authorised to accept parcels at the delivery address.
Customers should therefore avoid using an address where parcels may be accepted by someone they do not trust.
13. SECURITY COMPLEXES, ESTATES & OFFICE BUILDINGS
Customers are responsible for ensuring that the courier can reasonably access the nominated delivery location.
Please provide relevant information such as:

Gate codes;
-
Unit numbers;
-
Building names;
-
Reception details; or
-
Security instructions
where appropriate.
If estate or building rules prevent the courier from reaching the customer's door, delivery may be made according to the lawful and reasonable procedures of that location.
14. FAILED DELIVERY ATTEMPTS
Courier companies may make one or more delivery attempts according to their own operational procedures.
A delivery may fail because:

Nobody is available;
-
The customer cannot be contacted;
-
Access to the property is refused;
-
The address is incorrect;
-
Security refuses entry;
-
The customer refuses delivery; or
-
Other customer-related circumstances prevent delivery.
Where the parcel must be returned to us because delivery could not be completed for a customer-related reason, the customer may be required to pay the reasonable courier cost of re-delivery.
15. UNDELIVERABLE PARCELS
If a parcel is returned to Oh So Naughty as undeliverable, we will attempt to contact the customer.
The customer may choose, where appropriate, to:

Arrange re-delivery; or
-
Request another lawful remedy where available.
Where non-delivery occurred because of incorrect information, customer unavailability, refusal of delivery or another circumstance attributable to the customer, reasonable additional shipping charges may apply.
16. REFUSED DELIVERY
Please do not refuse a correctly addressed parcel simply because you have changed your mind about the purchase.
Refusing delivery does not automatically convert the transaction into an approved return or cancellation.
Where a customer refuses a correctly supplied parcel, the matter will be dealt with according to our Terms & Conditions, Returns Policy and applicable law.
Reasonable return or re-delivery costs may apply where permitted by law.
17. DELIVERY DELAYS
If tracking shows that your parcel has been delayed, please contact us so that we can follow up with the courier.
A delay does not automatically mean that a parcel has been lost.
Courier investigations may be required before a parcel can reasonably be classified as lost.
Where applicable, we will assist with the investigation and provide the appropriate remedy required by law.
18. LOST PARCELS
If a parcel appears to have been lost during delivery, please contact:
We may request the courier to conduct an investigation.
Customers may be asked to provide reasonable information necessary for the courier investigation.
Where it is established that the parcel was lost before valid delivery occurred, Oh So Naughty will provide an appropriate remedy in accordance with applicable law.
19. PARCEL MARKED DELIVERED BUT NOT RECEIVED
If tracking indicates that a parcel has been delivered but you cannot locate it, please:

Check whether another person at the delivery address accepted the parcel;
-
Check with reception, security, concierge or mailroom staff where applicable;
-
Check the delivery location and surrounding safe areas; and
-
Contact us promptly if the parcel still cannot be located.
We will request relevant delivery information from the courier where appropriate.
This may include:
-
Delivery scan;
-
Delivery time;
-
Receiver name;
-
Signature where available;
-
Driver information;
-
GPS or location data where available; or
-
Other proof of delivery.
A claim will be assessed according to the available evidence and applicable law.
20. RISK OF LOSS OR DAMAGE DURING DELIVERY
Oh So Naughty remains responsible for the goods during delivery to the extent required by applicable South African law.
We do not attempt to transfer the legal risk of an undelivered parcel to the customer merely because the parcel has been handed to a courier.
Once valid delivery and acceptance have taken place, responsibility for the safe keeping of the parcel ordinarily passes to the customer, subject to applicable law.
21. DAMAGED PARCELS
If your parcel arrives damaged, please retain:

The outer courier packaging;
-
Courier label;
-
Inner packaging;
-
Product packaging; and
-
The affected item.
Please contact us as soon as reasonably possible and provide photographs showing:
-
The outside of the parcel;
-
Any damaged areas;
-
The inside of the parcel;
-
Product packaging; and
-
Any damaged product.
Please do not dispose of the packaging before we have had a reasonable opportunity to assess the claim.
Damaged-product claims are dealt with under our Returns, Exchanges, Refunds & Product Warranty Policy.
22. INCORRECT OR MISSING ITEMS
If you receive:

The incorrect product;
-
An incorrect quantity; or
-
An order with an item missing,
please contact us as soon as reasonably possible.
For an incorrectly supplied intimate product, please do not open or use the product once you become aware that it is incorrect.
Please send:
-
Your order number;
-
A description of the issue; and
-
Photographs where appropriate.
We will investigate and provide the appropriate remedy.
23. SPLIT DELIVERIES
Some orders may occasionally be dispatched in more than one parcel.
This may occur where:
-
Products are located at different fulfilment locations;
-
Supplier fulfilment is used;
-
Stock becomes available at different times; or
-
Operational circumstances require a split shipment.
Where reasonably possible, we will provide relevant tracking information for each shipment.
A partial delivery does not necessarily mean that the remainder of the order is missing.
24. STOCK OR SUPPLIER DELAYS
Some items may occasionally be subject to supplier availability.
If a product cannot be dispatched within the expected timeframe, we will make reasonable efforts to notify you.
Where we cannot fulfil an order within the agreed or legally required timeframe, the customer will retain any cancellation or refund rights provided by applicable law.
25. DELIVERY WITHIN THE AGREED PERIOD
Where an online transaction is governed by ECTA, orders will be fulfilled within the period agreed with the customer or otherwise within the period required by applicable law.
If Oh So Naughty is unable to fulfil the order within that period, the customer's statutory rights will remain unaffected.
26. FREE SHIPPING
Where an order qualifies for free shipping, Oh So Naughty will pay the standard Economy Shipping charge.
Free shipping does not necessarily cover:

Re-delivery caused by customer error;
-
Courier redirection requested after dispatch;
-
Special delivery services;
-
Additional outlying-area services where specifically disclosed; or
-
Other additional delivery services requested by the customer.
27. DELIVERY PROMOTIONS
From time to time, we may run:

Free-shipping promotions;
-
Reduced-delivery promotions;
-
Coupon-based delivery discounts; or
-
Other shipping offers.
Each promotion may have its own:
-
Minimum spend;
-
Geographic limitations;
-
Validity period; or
-
Qualifying products.
Promotional shipping conditions will be disclosed with the relevant offer.
28. DELIVERY PRIVACY
Because our customers purchase adult and intimate products, we take reasonable care not to unnecessarily disclose the contents of parcels.
However, the customer is responsible for choosing a delivery location where they are comfortable receiving a parcel.
Oh So Naughty cannot guarantee that another person at the address will not see or accept the parcel.
29. CHANGES TO SHIPPING RATES
Shipping rates may change from time to time because of changes in courier costs or operational requirements.
The rate shown at checkout at the time the order is placed will apply to that order, unless an obvious error has occurred and applicable law permits correction.
